Terms & Conditions

Please read these enterprise service terms carefully before using MadStack offensive security platform and scanning services.

1 Acceptance of Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between MadStack Inc. ("MadStack", "Company", "we", "us") and the individual or enterprise entity ("Customer", "User", "you") accessing or utilizing the MadStack cybersecurity platform, scanning engines, CLI tools, and automated remediation services.

By signing an Order Form, registering an account, or invoking any MadStack API endpoint, you explicitly agree to be bound by these Terms. If you are entering into this Agreement on behalf of a company, you represent that you possess the requisite legal authority to bind that entity.

2 Services Description

MadStack provides offensive security and continuous testing capabilities, including but not limited to:

Penetration testing & continuous assessments: Expert-led and platform-assisted tests across applications, APIs, and infrastructure.

Code, cloud & runtime coverage: Scanning and analysis of source code, dependencies, cloud configurations, containers, and live workloads.

Reporting & prioritization: Findings ranked by exploitability and business impact, with remediation guidance.

Specific scope, deliverables, and timelines are defined in the applicable Order Form or Statement of Work.

3 Accounts & Access

You are responsible for maintaining the confidentiality of account credentials and for all activity under your account. You must:

Provide accurate registration and billing information and keep it current.
Restrict access to authorized personnel only and notify us promptly of any unauthorized use.
Ensure that targets in scope are systems you own or are authorized to test.

4 Acceptable Use

You may use the Services only for lawful security testing and improvement of systems under your control or authorization. You agree not to:

Test systems without explicit authorization from the asset owner.

Use the platform to attack, disrupt, or gain unauthorized access to third-party systems.

Resell, sublicense, or reverse engineer the Services except as permitted by law.

Circumvent usage limits, authentication, or security controls of the platform.

5 Intellectual Property

MadStack retains all right, title, and interest in the platform, software, methodologies, reports templates, and related IP. You retain ownership of your data, code, and systems. Subject to payment of applicable fees, you receive a limited, non-exclusive license to use reports and findings solely for your internal security and compliance purposes.

6 Confidentiality

Each party agrees to protect the other's confidential information with reasonable care and not to disclose it to third parties except as needed to perform under these Terms or as required by law. Vulnerability findings and customer environment details are treated as Customer confidential information.

7 Disclaimers

Security testing reduces risk but cannot guarantee that all vulnerabilities will be found or that systems will remain secure. Except as expressly stated in an Order Form, the Services are provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.

8 Limitation of Liability

To the fullest extent permitted by law, MadStack's total liability arising out of or related to these Terms or the Services shall not exceed the fees paid by Customer for the Services giving rise to the claim in the twelve (12) months preceding the claim. Neither party shall be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, even if advised of the possibility of such damages.

9 Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to account administrators or notice on our website. Continued use of the Services after the effective date of updated Terms constitutes acceptance, except where an Order Form states otherwise.
